Occupational schemes - trust provisions and scheme rules

In 2006 we gave you information on the changes introduced by the Finance Act 2004 and Pensions Act 2004 and told you about the need to reflect these changes in the trust provisions and rules for your scheme. To allow you to do that, we provided you with draft scheme rules and supporting documents to help guide you through the process.

Since April 2006, our administration of your scheme has assumed that you adopted the rules, using our draft document, unamended, unless you've told us otherwise. If you haven't adopted the rules we provided, please seek independent legal advice.

Adopting the rules checklist

  1. Urgently check with the employer and your legal advisers whether you formally adopted and signed the rules we provided.
  2. Make sure you've given copies of the documents to the employer.
  3. Check you've told members about the changes.
  4. If you didn't use the draft document we provided, contact your legal advisers as soon as possible.
  5. Tell us if you didn't adopt the rules we provided.
